These Terms & Conditions ("Terms") govern your use of the Spelld mobile application ("App") developed and operated by Oleg Kobets ("Developer", "we", "us", or "our"). If you do not agree to these Terms, do not download or use the App.
You must be at least 13 years of age (or the minimum age required in your country) to use the App. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf.
We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a personal mobile device you own or control, solely for your personal, non-commercial entertainment purposes. This licence does not include the right to:
The App, including its name "Spelld", logo, design, graphics, game mechanics, word lists, sounds, and all other content, is the exclusive property of the Developer or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any ownership rights in the App or its content.
Spelld may offer optional in-app purchases such as hints, power-ups, or cosmetic items ("Purchases"). All Purchases are:
We reserve the right to modify, suspend, or discontinue any in-app item or feature at any time without liability to you.
You agree not to use the App to:
We reserve the right to suspend or terminate your access to the App for violations of these rules.
We may, at our sole discretion, update, modify, or discontinue the App (or any part of it) at any time without prior notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the App or any in-app purchases in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App or your violation of these Terms.
The App may contain links to third-party websites, services, or resources. We are not responsible for the content, policies, or practices of any third party. Accessing such third-party services is at your own risk.
These Terms are governed by the laws of the State of Western Australia, Australia, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Western Australia, Australia.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through an in-app notice. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
